What is The Office of Chief Counsel?
The Office of Chief Counsel is a part of the Food and Drug Administration or FDA. The Office of Chief Counsel acts as a central housing unit for those that oversee the workings of the centers within the FDA. Without the central housing unit, each unit would not abide by the rules set forth for all of the centers, but rather have their own set of rules. Each does have their own set of rules, but all have to comply with the main pharma compliance in the US.
Currently there are seven spots in the counsel. The head counsel member being the Chief Counsel. From there, the Principle Deputy Chief Counsel and Acting Deputy Chief Counsel for Program Review for Medical Devices, the Senior Adviser to the Chief Counsel, the Deputy Chief Counsel for Litigation, the Deputy Chief Counsel for Program Review for Food and Veterinary Medicine, the Deputy Chief Counsel for Program Review for Drugs and Biologics and the Acting Deputy Chief Counsel for Program Review for Tobacco. Each oversees their particular section of the Food and Drug Administration, but also act on the Counsel and work with the Chief Counsel for all parts of the administration.
Each person that works with the Food and Drug Administration has to pass the approval of the board members for the product that they are offering before it is able to go to the general public. There are various pharmaceutical and medical device compliance's that have to be gone through in order to have the product be safe to use for the general public.
What Does the Chief Counselor Do?
The litigation aspect of the counselors oversees all of the criminal and civil aspects of enforcement cases and they are able to defend the challenges that arise to the provisions and guidelines that come with the Federal Food, Drug and Cosmetic Act, FDA policies, decisions, initiatives and so on. They make sure to do the right job for the agency to provide the right legal counsel as needed. They can draft a wide assortment of documents pertaining to the law for the agency and accept, sign and push through approvals through the sections of the FDA.
The counselors throughout the office are able to oversee many different sections to ensure that they are operating at the right capacity and being able to pass the products that go through their offices. Each of the sections of the FDA have to abide by certain guidelines, rules and pharmaceutical compliance's to ensure that everyone that uses the drugs, food or other products are safe while using them.
The Chief Counselor is also able to bring up new plans and implement new strategies for testing the products that are within the system to make the approval process easier for some but also more efficient. They are the boss for those higher and in charge of the sections throughout the FDA and all decisions, approvals, denials and additional information go through the Chief Counsel at the top of the ladder. They then are able to state whether or not they approve of the decision that was made by the section of the FDA that the product is from.
